Ashtamapa Terms of Use
Effective date: [DATA DE VIGÊNCIA]
These Terms set the rules for using Ashtamapa. By creating an account or subscribing, you agree to them. Please also read the Health Notice, the Privacy Policy and the Cancellation and Refund Policy. They are part of these Terms.
1. Who we are
Ashtamapa is provided by [RAZÃO SOCIAL OU NOME], registration no. [CPF/CNPJ], address [ENDEREÇO]. Contact: [E-MAIL DE CONTATO].
In these Terms, "we" and "us" mean Ashtamapa and its provider. "You" means the person using the app.
2. What Ashtamapa is
Ashtamapa is a web app (PWA) for Ashtanga-style yoga. It offers:
- pose cards with explanations, variations and precautions;
- content organized in three levels;
- suggested adjustments based on the pain and mobility you report.
The adjustments are automatic and depend only on what you enter. They are not a clinical assessment or a prescription. The content is educational. See the Health Notice.
3. Who can use it
You must be at least 18 years old and able to enter into a contract. The app is not intended for anyone under 18.
4. Your account
- To subscribe, you provide your name and email address.
- You sign in with a code sent to your email. There is no password.
- Keep your email account secure. Anyone with access to your email can sign in to your account.
- Your account is personal. Do not share access.
- Tell us at [E-MAIL DE CONTATO] if you suspect misuse.
5. Subscription and automatic renewal
- Full access to the content requires a subscription.
- Plans, billing period (for example, monthly or yearly) and price are shown on the subscription page before you pay.
- Your subscription renews automatically at the end of each period, for the same length and at the current price, until you cancel.
- Renewals are charged to the same payment method at the start of each new period.
- Before you pay, you see the total amount, the billing period and the next billing date.
6. Prices and currencies (BRL and USD)
- We charge in Brazilian reais (BRL) or US dollars (USD). The currency is shown on the subscription page before you pay.
- If you pay in a currency different from your card's currency, your bank may charge fees, taxes or exchange-rate differences. We do not charge or receive these amounts.
- Taxes that apply in your country may be added where the law requires. This will be shown before you pay.
- We may change our prices. If your subscription price changes, we will email you at least 30 days in advance. The new price applies only from the first renewal after the notice. If you do not agree, you can cancel before then.
7. Payment
- Payments are processed by Stripe, a payment provider.
- You enter your card details directly with Stripe. We do not receive or store your full card number.
- If a payment fails, we may retry it and suspend access until the payment is made.
8. Cancellation
- You can cancel at any time, with no fee, from the account area in the app or by email to [E-MAIL DE CONTATO].
- When you cancel, automatic renewal stops. You keep access until the end of the period you already paid for.
- Except as described in section 9, we do not give partial refunds for the current period.
9. Right of withdrawal and refunds
Purchases made in Brazil. Under article 49 of the Brazilian Consumer Protection Code (CDC), you may withdraw from your subscription within 7 (seven) days of purchase. We will refund the full amount paid, at no cost to you. Just ask from the account area or by email to [E-MAIL DE CONTATO]. The refund goes back to the same payment method. How long it takes to appear on your statement depends on your bank or card issuer.
Purchases made outside Brazil. You may request a full refund within 7 (seven) days of the first subscription charge. If the law of your country gives you a longer period or better terms (for example, the 14-day period for consumers in the European Union), the terms more favorable to you apply.
See the Cancellation and Refund Policy for details.
10. License to use the content
While your subscription is active, we grant you a personal, non-exclusive, non-transferable and revocable license to access and use the app's content for your own personal, non-commercial practice.
11. What you may not do
You may not:
- copy, bulk-download, reproduce, resell, sublicense or redistribute the content (text, pose cards, images, illustrations, audio, video), in whole or in part;
- post the content on websites, social media, groups or courses;
- use the content to teach classes or build paid products;
- share your account or sign-in codes;
- try to bypass billing, access restricted areas or disrupt the app;
- use bots or automated tools to extract content.
If you break these rules, we may suspend or close your account, with notice where possible.
12. Intellectual property
- The text, pose cards, content structure, the "Ashtamapa" name, the design and the code of the app belong to [RAZÃO SOCIAL OU NOME] or are used with permission.
- These Terms do not give you any rights to them beyond the license in section 10.
13. Third-party images and content
- Some images in the app belong to third parties and are used under their own licenses, such as Creative Commons licenses, the Unsplash License or the Pexels License.
- Credits and licenses for these images are listed on the app's Credits page.
- These rights remain with their authors. The license in section 10 does not allow you to reuse these images outside the app. For that, check each image's original license.
- If you are the author of an image and believe it was used incorrectly, write to [E-MAIL DE CONTATO]. We will review it and, if needed, fix the credit or remove the image.
14. Availability and changes to the app
- We work to keep the app available, but it may be interrupted for maintenance, technical failures or third-party issues (such as hosting or payments).
- We may update, add or remove content and features. If a change significantly reduces what you paid for, we will tell you and you may cancel. In that case, we will consider a pro-rata refund for the unused period.
- Your pain and mobility records are stored only on your device. If you clear your browser data, change devices or uninstall the app, these records may be lost. We do not have a copy.
15. Health and liability
- Ashtamapa content is educational. It does not replace a doctor, physiotherapist or in-person yoga teacher.
- You practice at your own pace and are responsible for respecting your limits and following the Health Notice.
- We are liable for damage we cause, as provided by law. We are not liable for damage caused by using the content against the Health Notice, by incorrect information you enter, by failures of third-party services outside our control, or by events beyond reasonable control (force majeure).
- Nothing in these Terms limits or excludes rights that consumer law gives you, including under the Brazilian Consumer Protection Code and the mandatory consumer laws of your country. Any limitation here applies only to the extent the applicable law allows.
16. Closing your account
- You can close your account at any time by email to [E-MAIL DE CONTATO].
- We may close or suspend accounts for breach of these Terms, fraud or legal requirements.
- If we shut down the service entirely, we will give reasonable advance notice and refund the unused part of the period you paid for.
17. Changes to these Terms
We may update these Terms. If a change is significant, we will tell you by email or in the app before it takes effect. If you do not agree, you can cancel your subscription. The date at the top shows the current version.
18. Governing law and jurisdiction
- These Terms are governed by Brazilian law.
- For consumers in Brazil, the courts of the consumer's place of residence have jurisdiction, as guaranteed by the Brazilian Consumer Protection Code.
- In all other cases, the courts of [CIDADE/UF DO FORO], Brazil, have jurisdiction.
- For consumers outside Brazil, the choice of Brazilian law does not take away the mandatory protections of the law of the country where you live, nor your right to go to the courts of that country where local law allows it.
- Before taking any action, please contact us at [E-MAIL DE CONTATO]. We want to solve things simply. Consumers in the European Union may also use their national consumer dispute resolution bodies.
